These SMS Terms and Conditions ("SMS Terms") govern your use of NeighborLink's text messaging services. By opting in to receive SMS messages from your HOA through NeighborLink, you agree to these terms.
Quick Summary: By texting a keyword or providing your phone number, you consent to receive SMS messages from your HOA via NeighborLink. You can opt-out anytime by texting STOP. Message and data rates may apply.
1. Consent to Receive SMS Messages
By opting in to NeighborLink SMS notifications, you:
- Consent to receive automated text messages from your HOA or community association
- Acknowledge that consent is not a condition of purchasing any goods or services
- Agree that your consent applies to messages sent via NeighborLink's platform
- Understand that messages will be sent to the mobile phone number you provided
2. Types of Messages
You may receive the following types of SMS messages:
- Community Announcements: Important updates about your neighborhood
- Emergency Alerts: Urgent safety or security notifications
- Event Reminders: Notifications about upcoming community events
- Broadcast Messages: General communications from HOA administrators
- System Messages: Service updates and confirmations
3. Message Frequency
Message frequency varies and depends on:
- Activity level in your neighborhood
- Announcements from your HOA administrators
- Your notification preferences
Typical frequency ranges from 1-20 messages per month, but may be higher during emergencies or active community periods.
4. Cost and Carrier Charges
- Message & Data Rates: Standard message and data rates from your mobile carrier may apply
- No NeighborLink Fees: NeighborLink does not charge you for SMS messages
- Carrier Plans: Consult your mobile carrier regarding your messaging plan and rates
- Unlimited Plans: If you have an unlimited texting plan, standard rates typically don't apply
5. Supported Carriers
NeighborLink SMS services are available on most U.S. mobile carriers, including:
- AT&T, Verizon Wireless, T-Mobile, Sprint
- Boost Mobile, Cricket, MetroPCS, U.S. Cellular
- Virgin Mobile, and other major carriers
Carriers are not liable for delayed or undelivered messages.
6. How to Opt-Out (STOP)
You can stop receiving SMS messages at any time by:
- Texting STOP: Reply "STOP" to any message you receive
- Account Settings: Update your notification preferences in your NeighborLink account
- Contact Admin: Ask your HOA administrator to remove you from SMS notifications
After opting out, you will receive one final confirmation message, then no further messages will be sent unless you re-opt-in.
7. How to Get Help (HELP)
For assistance with SMS messages:
- Text HELP: Reply "HELP" to any message for more information
- Email Support: Contact sms@neighborlink.space
- HOA Admin: Reach out to your community administrator
8. Privacy and Data Protection
Your phone number and message data are protected under our Privacy Policy. Key points:
- We only use your phone number to send community-related messages
- We do not sell or share your phone number with third parties for marketing
- SMS messages are sent via Twilio, subject to their privacy policy
- Message content and delivery logs may be retained for service quality
9. Message Delivery
No Guarantee: While we strive for reliable delivery, we cannot guarantee:
- Messages will be delivered to your phone
- Messages will arrive in a timely manner
- Messages will be received in the order sent
Delivery Issues: Messages may fail or be delayed due to:
- Carrier network issues or outages
- Poor cellular signal or coverage
- Phone turned off or out of battery
- Phone number changes or cancellations
- Phone storage full or messaging app issues
- Carrier spam filters or blocks
10. Your Responsibilities
You agree to:
- Provide accurate and current mobile phone number
- Update your phone number if it changes
- Ensure you have sufficient message plan/credits
- Notify us if you stop receiving messages unexpectedly
- Use the opt-out mechanism if you no longer wish to receive messages
11. Prohibited Uses
You may not:
- Use the SMS system to spam or harass others
- Attempt to interfere with SMS delivery systems
- Impersonate others when responding to messages
- Use automated systems to interact with the SMS service
12. Disclaimer of Warranties
SMS services are provided "as is" without warranties of any kind. We do not warrant that:
- Messages will be delivered reliably or on time
- The service will be uninterrupted or error-free
- Messages will meet your specific requirements
13. Limitation of Liability
H Tech Labs LLC and NeighborLink shall not be liable for:
- Costs incurred from receiving SMS messages
- Delays, failures, or errors in message delivery
- Actions taken (or not taken) based on message content
- Damages resulting from reliance on SMS messages
- Issues caused by your mobile carrier
14. Emergency Communications
Important Notice:
- SMS messages should not be used for life-threatening emergencies
- Always call 911 for immediate emergency assistance
- Do not rely solely on SMS for critical safety information
- Maintain alternative methods of emergency communication
